1. ABOUT US AND OUR BUSINESS MODEL

1.2 To offer the widest variety, at AquiMejor we operate with a mixed model: we sell products managed and shipped directly by us, and we also offer products sold and shipped by a network of partner sellers ("Partners"). These Terms and Conditions apply to all purchases made on the Website, regardless of who the final seller of the Product is.

2. YOUR STATUS

By placing an Order on our Website, you ensure that:

- You are over 18 years of age.

- You reside in the European Union.

3. APPLICATION

3.1 These Terms and Conditions shall apply to any Order or Contract made or to be made with the purpose of selling and distributing our Products. Placing an Order constitutes unreserved acceptance of these Terms and Conditions.

3.2 These Terms and Conditions shall prevail over any independent document that is signed.

4. FORMALIZATION OF CONTRACTS

4.1 You can place your Order as a guest or by creating an account on the Website. In either case, follow the instructions on how to place and modify the Order before finalizing it. If you buy as a guest and later need to request a return, you can do so by creating an account with the same email address you used for the Order, or from the link or QR code included in the delivery note with your parcel.

4.2 Once a Product has been selected for your Order, the corresponding price will be displayed, which will include VAT and any applicable shipping costs. Unless otherwise stated, all prices will be shown in Euros.

4.3 In order to complete the purchase process, you must pay the full amount of the Order. The available payment methods are: Credit or debit card (via secure SSL payment gateway), Bizum, PayPal, Google Pay, Apple Pay, and the deferred and installment payment service via Sequra (available only for deliveries with a Spain address). We reserve the right not to offer certain payment methods for specific orders and to redirect you to others.

4.4 You are responsible for ensuring that all data provided for the purchase is correct and that the payment methods used belong to you and have the necessary funds.

4.5 I agree to receive invoices and credit notes for my returns solely and exclusively in electronic format.

4.6 If, once the Order is completed, you discover that it contains an error, please contact us immediately. We cannot guarantee the modification of the Order according to your instructions.

4.7 AquiMejor reserves the right to modify prices. The purchase price will be the one in effect at the time of closing the transaction, except in case of manifest error. In the event of a pricing error, we will contact you to cancel the Order and issue the corresponding refund or offer an alternative.

5. DELIVERY

5.1 We will deliver the Products to the shipping address listed in your Order.

5.2 Delivery times and costs vary depending on the product's seller (AquiMejor or a Partner) and the destination. All detailed information regarding costs and estimated delivery times will be specified on each product's file and clearly broken down in the shopping cart before finalizing the order. 5.3 We will inform you of any delay in the shipment of the Order. However, to the extent permitted by law, we are not responsible for any losses, liabilities, costs, damages, or charges arising from such delay.

5.4 Upon delivery of the Order, the recipient's signature may be required. Please check that the Product does not show manifest faults, defects, or damage before signing.

5.5 If delivery or collection is delayed due to an unjustified refusal, or if you do not accept or collect the package from the courier office, we may charge you storage fees and any other reasonable costs that may arise and/or terminate the applicable Contract.

6. PRODUCT UNAVAILABILITY

6.1 If a Product is unavailable after the Order has been placed, we will contact you to offer a similar product or cancel the Contract and refund the amount paid.

7. CANCELLATION AND RETURNS

7.1 You have 30 calendar days from the receipt of the Product to request a return. To start the process, you must access the orders section in your customer account.

7.2 The address for returning the Product will depend on whether the seller is AquiMejor or one of our Partners. The correct shipping address will be provided to you along with the return label during the online request process. It is your responsibility to send the product to the indicated address.

7.3 During the first 14 calendar days, under your right of withdrawal, you may unpack and examine the Product to check its nature, characteristics and functioning, just as you would in a physical shop. You keep that right even if you have opened the packaging.

However, if the Product reaches us with a reduction in value resulting from handling beyond what is necessary for that check —for example without its original packaging, incomplete, without accessories or manuals, or with broken seals or warranty stickers—, the amount corresponding to that depreciation will be deducted from the refund.

Sealed Products that are not suitable for return for health protection or hygiene reasons, and sealed audio or video recordings and software, cannot be returned once unsealed after delivery.

From day 15 to day 30, under our extended returns policy, which we offer voluntarily beyond what the law requires, we only accept unused Products with factory seals intact.

8. DEFECTIVE PRODUCTS

8.1 We guarantee that the Products will conform to the characteristics specified by the manufacturer. We make every effort to deliver the Products in optimal condition.

8.2 In the event of receiving a Product that you consider defective, please contact us so we can manage it. In case of a defective product, the seller shall proceed, as appropriate, to repair, replace, reduce the price, or terminate the contract, which will be free of charge for the consumer. Under Spanish Law 11/2022, the seller is liable for any lack of conformity that becomes apparent within a period of three (3) years from delivery of the goods, and two (2) years in the case of digital content or services. During the first two (2) years, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery, unless proven otherwise. The consumer has five (5) years from the moment the lack of conformity appears to bring a claim. Where the Product has been sold by a Partner, that Partner is liable for the legal guarantee on the same terms, with AquiMejor assisting in the process.

9. VOUCHERS

9.1 You can use gift vouchers or promotional vouchers as a form of payment for your Orders on the Website, in accordance with the specific conditions of each voucher.

10. LIMITED LIABILITY

10.1 Nothing in these Terms and Conditions shall limit or exclude our Liability regarding (i) willful misconduct or gross negligence; (ii) death or personal injury caused by breach of our duty; or (iii) any Liability that cannot be limited by applicable law.

11. GUARANTEE AND COMPLAINT MANAGEMENT

11.1 Customer satisfaction is of utmost importance. You can contact us at any time through the channels indicated in clause 1.1.

12. DATA PROTECTION

The processing of your personal data is governed by our Privacy Policy.

13. FORCE MAJEURE EVENTS

13.1 We are not responsible for any non-compliance, impediments, or delays in fulfilling a Contract attributable to any force majeure cause.

14. GENERAL

14.1 These Terms and Conditions are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user's domicile.

14.2 We reserve the right to amend these Terms and Conditions at any time. Any amendment will be published online. Continuous use of the Website will imply the acceptance of the new Terms and Conditions.
